By accessing or using ChartGlow, a service provided by Zest4ad SAS ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

ChartGlow is a data visualization platform that allows users to create animated charts and export them as video files. We provide both free and paid subscription tiers.

3. AI Features & Data Disclaimer

Our service includes features powered by Artificial Intelligence (AI) to assist with data generation, cleaning, and validation. By using these features, you acknowledge and agree that:

• Accuracy Not Guaranteed: AI-generated content is probabilistic and may contain errors, inaccuracies, or hallucinations. We do not warrant the accuracy, completeness, or reliability of any AI-generated data.
• User Responsibility: You are solely responsible for verifying and fact-checking any data, text, or images generated or processed by our AI tools before using, publishing, or relying on them.
• No Professional Advice: AI outputs should not be considered as professional financial, legal, or medical advice.

4. User Accounts

To use certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

5. Intellectual Property

You retain all rights to the data you upload to ChartGlow. By using the service, you grant us a license to process your data solely for the purpose of providing the service to you. The ChartGlow platform, including its software, design, and branding, is the exclusive property of Zest4ad SAS.

6. Subscriptions and Payments

Billing: Paid subscriptions (Premium) are billed in advance on a recurring basis (monthly or yearly). By subscribing, you authorize us to charge your payment method automatically at the start of each billing period.

Cancellation: You can cancel your subscription at any time through your account dashboard. The cancellation will take effect at the end of the current paid term.

Refunds: Refunds are handled in accordance with our Refund Policy. Generally, we offer a 7-day money-back guarantee for new subscriptions, but do not refund partial months for cancellations.

Price Changes: We reserve the right to change our pricing. We will provide at least 30 days' notice before any price change takes effect for existing subscribers.

7. Limitation of Liability

To the maximum extent permitted by law, Zest4ad SAS shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service, including but not limited to damages arising from the use of AI-generated data which may be inaccurate or misleading.

8. Governing Law

These terms are governed by the laws of France. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in France.
